Terms of Use
1. Who you are agreeing with
These terms are between you and Anoop Hallimala, 57/1 Desai Garden, Vasanthapura Main Road, Vasanthapura, Bangalore 560062, Karnataka, India ("we", "us"). By downloading or using the EyeCalibrate app, you accept them. If you do not accept them, please do not use the app.
You must be 18 or over to accept these terms. EyeCalibrate is intended to be set up and supervised by a parent or guardian on behalf of a child.
2. EyeCalibrate is not medical advice or a medical device
This is the most important section of these terms. Please read it.
- EyeCalibrate provides vision training games and exercises. It is not a medical device, it has not been evaluated or cleared by any medicines or medical devices regulator, and it is not intended to diagnose, treat, cure or prevent any disease or condition.
- It is not a substitute for examination, diagnosis or treatment by a qualified eye care professional, and it does not replace glasses, patching, eye drops, surgery or any treatment your eye doctor has prescribed.
- The Check-Up activities in the app are practice activities that record how your child performed on a screen on a given day. They are not an eye examination and must not be relied on to detect, rule out or monitor any condition. A result in the app — good or bad — is not a reason to change anything your eye doctor has told you.
- Always follow your eye care professional's instructions. Tell them you are using the app. If you have any concern about your child's vision, see an optometrist or ophthalmologist. If your child's vision changes suddenly, seek medical attention immediately.
- We make no claim that using the app will improve your child's vision.
3. Using the app safely
- Stop if your child reports headache, eye strain, dizziness, nausea or discomfort, and speak to your eye doctor before continuing.
- Take regular breaks. The app is designed for short sessions.
- Some activities use moving or flashing imagery. If your child has a history of seizures or photosensitive epilepsy, talk to their doctor before use.
- Supervise young children, particularly during setup.
4. Your account and your device
Your child's data is stored on your device. You are responsible for your device and for any backup of it. Deleting the app deletes that data and we cannot recover it, because we never had a copy. See the privacy policy.
5. Subscriptions and payment
Parts of EyeCalibrate require a paid subscription. Where you buy through the Apple App Store or Google Play:
- Payment is taken by Apple or Google, not by us, under their terms.
- Subscriptions renew automatically until cancelled. You can cancel at any time in your device's subscription settings — see Support. Cancelling stops future payments; access continues to the end of the period you have paid for.
- Where a free trial is offered, you will be charged when it ends unless you cancel beforehand.
- Refunds are handled by Apple and Google under their own policies. You may also have statutory cancellation rights depending on where you live. Contact us as well — we would rather sort it out than leave you unhappy.
- We may change prices. Any change applies to new billing periods, and existing subscribers will be told in advance as the app stores require. A price change never applies retroactively to a period you have already paid for.
6. What you may not do
- Copy, resell, sublicense or redistribute the app or its content
- Reverse engineer it, except where law expressly permits
- Use it to provide a commercial service to third parties without our written agreement
- Attempt to bypass payment or interfere with the app's operation
7. Content in the app
The cartoon channel streams films that are in the public domain or made available under open licences by their respective rights holders. All other content, and the app itself, remains our property or that of our licensors. You get a personal, non-exclusive, non-transferable licence to use it for your own family.
8. Availability
We try to keep the app working but we do not promise it will be uninterrupted or error-free. Streaming features depend on third-party services that may change or stop. We may modify or discontinue features; if we discontinue a paid feature substantially, you may cancel and seek a refund for the unused period.
9. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, the app is provided "as is", and to the fullest extent permitted by law we exclude implied warranties and are not liable for indirect or consequential loss. Where we are liable, our total liability is limited to the amount you paid us in the 12 months before the claim.
If you are a consumer, you keep all rights the law of your country gives you, and nothing here reduces them.
10. Changes
We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app. Continuing to use the app after a change means you accept the updated terms.
11. Law
These terms are governed by the laws of India. If you are a consumer, you may also bring proceedings in your own country and rely on its mandatory consumer protections.
